The law says that courts shall not favor one sex over the other. And sometimes it seems that court orders do favor mothers. But this is often more a reflection of the family’s past practices. It may have been that during the marriage the mother was the primary care giver and the couple or the court wanted to continue that pattern.

But there is nothing which prevents that pattern from being changed. Midori is committed to fulfilling the California Legislature’s belief that children are best parented when they have frequent and continuing contact with BOTH parents. If a father does not have sufficient contact with the children, there is no reason why his contact cannot be increased, provided there are not other issues such as drug or alcohol abuse.

What is fair on paper is not necessarily fair to children. This is especially true with younger children. Children don’t understand math. They understand that they have to pack up their stuff after school on Wednesday and move to the other house. They understand that they don’t get to see one of their parents on Christmas. They understand that only one of their parents sees them at school events.

One of the main focuses of the court is to disrupt the childrens’ lives as little as possible. Sometimes this means deviating from 50/50. For example, the court may decide that the children shall spend the school week in one home, perhaps the home that is more homework oriented, and most of the weekends in the other parent’s home. But to make up for this inequity during the school year, the court will seek to have the children spend extra time with the weekend parent during the summertime.

Child custody is rarely fair. But then again, neither is divorce.
