Additional Family Law Related Services - Frequently Asked Questions (FAQ's)

1.) What is a pre-marital or post-marital agreement?
2.) Why do I need to have a new Will after I get a divorce?
3.) How difficult is it to adopt step-children?
4.) Why would I use a family law attorney to fight my criminal matter?

1.) What is a pre-marital or post-marital agreement? | Back to Top

Agreements can be entered into before or after the marriage vows are made. Either can set out how assets or debts are defined in a divorce or other event. There are many statutory rules regulating such agreements.

2.) Why do I need to have a new Will after I get a divorce? | Back to Top

Besides not allowing your ex-spouse to automatically inherit, you may want to alter provisions regarding the care and education of your children, which may or may not deal with your ex-spouse in the same manner as prior to the divorce. Drafting these documents makes clear to your loved ones your intentions. Not every divorcing couple wishes to sever all ties with their ex-spouse, but merely make limitations. Drafting new Wills and estate planning documents is an often a forgotten but very necessary step after divorce.

3.) How difficult is it to adopt step-children? | Back to Top

Adoption doesn't have to be a difficult or expensive process; this is especially true if the birth parents consent. Adopting step-children simplifies issues for insurance and benefits purposes. Also, adoption doesn't have to mean complete severance between the child and their birth parents. Communication between the child and their birth parents can be regulated through a Post-Adoption Agreement.

4.) Why would I use a family law attorney to fight my criminal matter? | Back to Top

Usually you would not. You would pay two attorneys, one for your criminal law case, the other for your family law case. But if your criminal law case is related to your family law case, and your family law attorney has years of experience as a criminal defense attorney, as does Midori, it would be something to seriously consider.

First, Midori has obtained "not guilty" jury verdicts and dismissals in most of her domestic violence cases. She has handled all kinds of drug and alcohol related offenses. Many of the facts and witnesses are likely common to both cases.

Second, "Why pay two attorneys to learn the same set of facts?"
